Non-US citizens do not need a visa to establish a company in the USA. On the other hand, having a company in the USA does not give you the right to live in the USA directly.

On the other hand, establishing a business in the USA provides the opportunity to obtain a visa if certain conditions are met. In particular, L-1 or E-2 visas can provide entrepreneurs with the opportunity to live in America in this context. While the L-1 visa allows you to stay in the United States for only up to 1 year at a time, the E-2 visa allows you to stay for up to two years and can be renewed again.

The L-1 visa is restricted to foreigners who own or operate a business outside of the United States. This type of visa is available by opening a branch in the USA of a company operating outside the USA. If this branch is successful in its activities, the one-year period may be extended again by the US government.

There are certain basic requirements for the E-2 visa type:

  • Being a citizen of a country that has a Friendship, Trade and Entanglement Agreement with the USA (Turkey is among these countries).

  • Have made or plan to make a significant investment for a US company. Although there is no minimum amount determined in this regard, an investment of less than $100,000 is not considered sufficient in practice. Another point taken into consideration in this regard is the size of this amount in personal assets.

  • To have control of the business.

The E-2 visa is renewable on an ongoing basis.

While E-2 and L-1 visas provide the opportunity to reside in the United States for a certain period of time, these individuals must also continue to reside outside the United States. These visa types are directly related to the person concerned, and spouses and children must also meet the necessary conditions for working or living in the United States.
